Hi All. I've been selling a firefighter knife (ASIN B0046ZLBS0) since about 2013 under my own PL brand. I've only sold several hundred on Amazon since inception so I won't be too upset if it's lost.
Today I received an intellectual property complaint (Complaint ID 17882907271) under trademark 7756650, which is newly registered and on the supplemental registry. The trademark is FIRE FIGHTER and applies to knives and cutting tools. My issue is that no where on the listing, not even on the keywords, does it say FIRE FIGHTER, instead it says firefighter, one word, not two. There is no trademark on USPTO for the word FIREFIGHTER as it applies to knives/cutting tools.
I'm really not sure if I should be filing a counter-notice or something else. Amazon only gives me two options, accept it or provide evidence of compliance. Within the evidence of compliance option I MUST check one of these boxes yet none seem to apply to me:
"Note: Generic explanations or any documents other than those requested do not meet the requirements for reinstatement.
1. A Letter of Authorization (LOA)/Licensing Agreement (LA) from the Rights Owner authorizing you to sell the product.
2. Invoice for the products sold under this ASIN
3. Order ID from Amazon.
4. Your registered Trademark number"
I tried searching for an answer on forums but either there aren't any good answers or Amazon's search feature is limited. I was able to find how to file a counter-notice on Amazons help pages but when I followed it step-by-step, it led me to the above 4 options only, which don't seem to apply. Any advice/direction will be appreciated!
