Received Intellectual Property Complaint Not Going Anywhere

Got a received property complaint a few weeks back for “Suspected Counterfeit”. I’ve supplied amazon with our invoice from the wholesaler that shows the items are legitimate and I’ve also supplied them with the wholesaler’s invoice (which they were kind enough to give to me) of them purchasing the product from the official brand.

I get nothing but the same copy-paste reply back from amazon about sending them XYZ to prove they’re a legitimate product. I’ve given them the evidence they asked for and they’re not accepting it? What more can I do?

From your post I understand that your listing has been taken down due to infringement complaints where you shared multiple invoices however it was rejected from the respective team.
In regards of your invoices as you stated that the invoices has been denied I would like to share the invoices requirement so you can check if your invoices are meeting all the requirements or not.
• The invoices or receipts from your supplier issued in the last 365 days.
• The document should reflect your sales volume during the last 365 days.
• The invoices should consist the details of the supplier including name, phone number and address.
• Highlight areas in your supporting documents. You can make your response more relevant by circling or highlighting the area within your documents that is most important such as ASINs, Supplier details (for example, name and supplier website) or clauses within your Terms and Conditions.
• Must be unaltered and legit.

If any of the invoices requirement is missing thereafter the invoices will be rejected.

I would recommend you to share plan of action where you need to justify the reason behind the infringing issue where you need to clarify the below points:

The root cause(s) of the issue:

  • Did you create the listing or it mapped from the exciting listing of Amazon?
  • Where were you procure those items?
  • If the products that led to the issue were generic in nature, why did you list them under a branded name?
  • If you do not have the approval, provide the reason why you have listed the product?
    Corrective Measure(s):
  • What have you done with the listing where you have received the trademark complaint?
  • Did you reach out the brand Right Owner to get retract about the complaint?
    Preventive Measure(s):
  • What is the process you will follow while sourcing and listing branded or generic items?
  • How will you ensure listing generic item as per the guidelines?
  • How will you ensure Amazon that you will sell only the products where you have authorization to sell?
  • What is the procedures that you will be following while listing the items?

You can appeal from the appeal button on the dashboard.
Since you have already mentioned that you have shared many appeals which was rejected, it would be helpful if you can share the most recent appeal with us so that we can assist you with the missing points.
