Suspended Account - Plan of Action
Hello fellow sellers,
What else can I do to get my account reactivated?
My account was suspended over 2 months ago due to 3 ASINS. One was due to Copyrights, 2nd was due to Counterfeit, and the 3rd was due to Design rights.
The first one was due to selling Pokemon figures I bought off Alibaba. The Rights owner (Nintendo) reported to Amazon due to Copyrights.
The 2nd and 3rd were due to selling earphones (the type of earphones that look exactly like the Airpods). I bought them from Alibaba just like other sellers. However, the owners of the listings reported me to Amazon that I was selling counterfeits and I have no rights to sell the/their earphones, even though they imported theirs from China too.
Amazon itself deleted these two ASINs from its website shortly after my notice. The listings do not exist anymore.
My last Plan of Action is below:
Proof of product authenticity.
I do not have proof of authenticity (e.g., Licensing Agreement or Letter of authorization) from brand/rights owners except the invoices issued by the sellers on Alibaba. Please find attached invoices.
The root cause of the issue.
The root cause of this issue is that I was selling non authentic items on Amazon.
I bought these items on Alibaba going by the description as being authentic item. When I bought the items, I believed they were really authentic as they were described as being original. However, due to reports received from rights owners via Amazon, I have now realised that they are not authentic as listed. I have no Letter of Authorization or Licensing Agreement from the rights owners.
The actions that you have taken to resolve the issue.
I have now removed and deleted all the stated listings concerned on all the marketplaces. And I have now decided that I would need to collect proof of authenticity e.g., Licensing Agreement and Letter of Authorization of any branded items from brand owners so as not to make this mistake again.
The steps that you have taken to prevent the issue going forward.
From now on, I will buy only from manufacturers and their authorised distributors. Also, I will make sure I regularly inspect my inventories so as to confirm their authenticity.
As stated above, I will now make sure I collect proof of authenticity e.g., Licensing Agreement and Letter of Authorization of any branded items from brand owners so as to verify authenticity and not to make this mistake again.
I am really really sorry for unknowingly selling these types of products. It will never happen again as I value Amazon and its customers, and will never knowingly do anything against its terms of service. Having realised my mistake, please kindly give me another chance to continue selling on the biggest online retailer the world as ever seen, as I will never knowingly compromise and hence jeopardise my family’s source of livelihood.
