Repeated false intellectual property complaints
Hi,
We received an intellectual property complaint from a competitor a couple of months ago. We successfully appealed and our product went live again.
However on Friday the same competitor made yet another intellectual property complaint for the same reason, we think this was timed to happen over the bank holiday weekend.
The complaint is exactly the same as last time however we do not have an intellectual property violation in account health and the product is not blocked, it just goes to a 404 page.
We submitted the same appeal that was successful a couple of months ago but this time Amazon are rejecting the appeal.
We have made numerous attempts to contact the complainant but they do not respond, I also have reason to believe that the person who made the complaint doesn’t actually exist.
Any suggestions about what to do?

The product is quite similar but has enough differences in that it is not infringing on their intellectual property.
In the first appeal I provided all evidence that I was not infringing and that the complainant was mistaken. Amazon accepted the appeal but apparently there is nothing stopping the same person from complaining again resulting in our listing being suspended again.

Could you post here Amazon’s rejection notice to see, why they failed to accept your appeal?
Because all Intellectual Property Rights Infringement appeals are different - some of them require invoices, others retraction notices or a Plan of Action.

As someone who has been through the exact thing, I know how frustrating it is. We have had the same person consistently making trademark/intellectual property complaints against us almost everyday for the last 2 months (71 complaints to be exact!). It`s clearly an abuse from the claimant to get us to stop us selling for a day or 2 and take our sales. I wonder why Amazon even lets the same person claim for the same reason when proof has already been provided that the claim is false.
Unfortunately I cannot guarantee it would work in your case but when our first appeal was successful, all we did was send a copy of our appeal each time when a new infringement complaint came and Amazon swiftly reinstated, usually within 24 hours.
Perhaps you could provide a new invoice with a different date? Or maybe you could ask Amazon exactly what the infringement is so they can stop wasting yours and their own time going round in circles.
What kind of genre is your product? We may be able to give more constructive advice if we can work out how a claim may have come about in the first place.!
