Received Intellectual Property Complaints
Hi, Can any one please help on understanding this issue.
Received Intellectual Property Complaint however, while listing product
Normally Amazon put limitations on all products if product can be listed on not.
Most of the time, while I list the products, Amazon says the following 3 main
things:
1- I can sell this product: and then I list it.
2- Product approval required: for which I request to be approved and once its
approved then I list it otherwise Not.
3- Restricted : Here I am unable to list any product.
So why would my I received this complaint as there was no limitations.
Amazon replied saying this at risk status will stay for 180 days
Isn’t this unfair or am I wrong in understandings?
Thanks

Was it for 3 ASINS? It may just be the standard 3 ASIN check.

Thank you Jackie,
This was the message!
We removed some of your listings because we received a report from a rights owner that they may infringe the rights owner’s trademark. The rights owner communication about the alleged infringement and the listings we removed are at the bottom of this message.

just because amazon are allowing you to sell it doesent mean that the rights owner allows you to sell it on amazon is anyone else selling it?

Almost certainly you do not have permission to list under the brand name on the listing and the person who owns this brand name has complained to Amazon.
Two possible reasons for this
-
The brand name on the listing matches the brand name on the product. In this case the person who owns the rights to the product does not want you selling the product on Amazon. You need to do some basic checks before listing the product that you can list the product on Amazon. These checks need to be done with the supplier/distributor/manufacturer to see if there are any restrictions on selling on Amazon.

The brand name on the listing does not match the brand name on the product. Then you have fallen into a trap many sellers fall into. You have found the product on Amazon under a brand name created by an Amazon Seller. You will not have the rights to sell the product under their brand name and you will have been kicked off the listing for that reason.

Thank you Everyone for your replies and almost I got the point.
Only question stays in my mind,
If that particular brand owner seller would like to restrict its products being sold by other seller, they must inform Amazon to allow restrictions of listing it by other sellers, as I have seen lot of products being sold on Amazon are restricted or need approval, so why not on this for example.
There is still a loophole somewhere or am i still being naive to get to the point?

I think you’re missing the point. Amazon may well restrict you selling certain products or in certain categories. This is completely different to you listing on a Brand you have no right to list on.
I have various brands with Trademarks. Amazon won’t stop you jumping on these listings, But if you do I will make a complaint of infringement and if upheld, your offer will be removed.

Hello again and Thank you Everyone for your support with your suggestions and answers.
There is no resistance from my end and these are my thoughts and off course we must comply with Monopolistic Rules as well.
I still believe Amazon should put restrictions from all Big Brands and smaller brand products so we must get authorised before we list it.
Bigger brands on AMAZON has put restrictions so why not smaller brands.
Also there are 1000s of videos and other stuff on youtube and other social media, promoting retail arbitraging and selling different brands products with out restrictions and which Amazon is authorising so why no one steps in and off course, Rule seems is "when you get caught you are punished otherwise CARRY ON UNTIL YOU get caught!
