Please help! Proof of product authenticity
Recently one of my products - a latex resistance band - had the parent ASIN suppressed, so that the child variations now are all listed separately, instead of on the same listing page. When I contacted support they told me to email notice.dispute@amazon.co.uk. I did that and they told me I have to provide proof of product authenticity because they have had a complaint from the “rights owner”. This very strange because the product is simply an elastic band, which has no patent or any intellectual property associated with it. I just stamp my own brand logo on it - I am the registered brand owner.
I have explained this to them, and I have sent them the invoice from my supplier as proof but they just keep replying with the same automated email (copied below). I have emailed them about ten times but it’s always the same reply. I am at my wits end as I do not know what else I can send them to prove that I’m not infringing anyone’s intellectual property. And I have no-one I can contact - seller support tell me I just have to send an email to that address, there’s no phone number or anything. Please can someone help me and tell me what I can do? Getting desperate here.
This is the email:
Hello,
Thank you for your message. We cannot accept your appeal because it does not address the report we received from the rights owner. Please provide the following information so we can process your appeal:
– Proof of product authenticity (e.g., invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that your products do not infringe any intellectual property rights. Please send this information, any other documentation, and a list of impacted ASINs to notice-dispute@amazon.co.uk.
Where do I send this information?
Send this information to notice-dispute@amazon.co.uk.
What happens if I do not send the requested information?
If we do not receive the requested information, the listing will remain removed and your account could be deactivated.
Has your listing been deactivated in error?
If you believe there has been an error, please tell us why. Your explanation should include the following information:
– How your listing(s) have not violated the brand’s intellectual property.

Is your brand a registered trademark of someone else? Try searching here: https://www.tmdn.org/tmview/welcome Latex resistance bands appear to fit into Nice class 10 or 28.
Do you have the original violation notice?

No it’s my own registered trademark. Maybe I should send them a copy of the trademark from the Intellectual Property Office?
They did not send me the original violation notice, or any information about the complainant. Which is strange.
The other strange thing is: why would they only suppress the parent ASIN instead of the whole family? All the variations are still there, but just showing as separate listings.

How have you checked this to ensure that you are not infringing on someone elses rights or patent?
If someone else trademarked the design, prior to your useage, then you would be in infringement
