Inauthenticity and how to Understand it

Hi, looking for some advice from someone who knows the ins and outs of what amazon consider to be inauthentic.
I have added a few asins to show what i mean,

B07TS43RSZ - Zella Exclusive Set of 5 Sour Toxic Waste Tubs of Sweets

So in this (example 1) Can anyone list this product m which is available in any UK confectionery wholesaler? or can only Zella List it, is it listed incorrectly? as it cant be by zella, but by toxic waste

EXAMPLE 2

The Ultimate Haribo Mini Bags Sweets Hamper - Hamper Exclusive to Burmont’s

by [Burmont’s Speciality Gifts]

In this example, I understand that we cannot list against this asin as its branded by burmonts etc and even has a trademark registered, However is this listing itself in breach of any policies, as its Haribo sweets, would you need permission from Haribo to create this listing,
Is this classed as bundling?
If we created a similar listing with our own trademark, could this be classed as inauthentic

Both are branded listings. The second is clearly branded as they are bundling products into their own branded packaging.

I’m not going to argue the validity of the branded listings, which is questionable given that they are branding a bundle of other trademarked items but…

In Amazon land if you do not have authorised invoices to match the brand of the ASINs you list against then you cannot list against that ASIN.

So, in the case of the second item, unless you have invoices to your business that state as a line item that you have purchased a genuine Burmont’s ‘Ultimate Haribo Mini Bags Sweets Hamper’ from something that serves as an official distribution or manufacturers sale’s channel then you should not list against it.

In the event of Amazon asking for verification invoices to prove authenticity you cannot prove it. The brand on the listing is not Haribo, it is Burmont’s (Burmont’s Speciality Gifts specifically) and this is what your invoices would need to reflect.
