Retailer selling Manufacturers product under their own brand - Duplicate Listing
Hello all,
Just needed some advice if I am allowed to sell under a duplicate listing.
There’s a main listing for the product which all retailers sell under including Amazon. (Over 1000 ratings).
Another retailer has created a new listing for the same product but has put the brand as themselves and undercutting on price.
I know that it will be the same product and branded by with manufacturer and not by the seller. I know this as we have a very close relationship with the manufacturer and know this particular retailer don’t have the product branded under their own flag.
Would we be allowed to sell under their new listing? Or should I order from that listing just to check if they’re sending the same product from the main listing and then report them?

no you can’t
they shouldn’t be creating the duplicate listing under their own brand but unfortunately many sellers do so that they don’t have to compete on price
as they have used their own brand name, they will no doubt report you if you list on that listing

Unless you are the authorised brand representative for the manufacturer it is unlikely Amazon are going to pay any attention to what you say or do.

if this is the case, you could report the seller to the manufacturer for ‘passing off’ a product that not theirs

I think the only solution is to report it to the manufacturer.
I mean in theory we could create another listing with our own brand name.

On the other hand, the manufacturer might not care either as they are getting the sale either way

Cannot create different ASINs with the same EAN and in this case if the product is same as you claimed thn the other ASIN might have been given a different EAN other thn the one on the product, and duplicate listing is not allowed.
If you can prove that - >report a violation and if your claim is right, incorrect ASIN should be removed.
As seniors suggested- dont list under incorrect ASIN at any cost.

If you are confident the product is identical, you can request that the listing is merged.
I must warn you that doing this could hurt the ranking of the products and can cause more harm than good for both you and the other seller but this would be the right way to deal with cloned products if removal is not an option.

A number of years ago I found someone selling my branded items (it had a size label with our brand name on) under their own branded listing.
After speaking with my trademark lawyer he said basically whatever the brand owner wants to sell under their brand name is up to them.
It is their brand. If they want to sell different branded items under their brand name there is nothing illegal about it. If they want to trash their brand it is their right. As long as it’s not harming / having a negative effect on my brand.
So I’m not sure what you will be reporting them for? Thinking outside the unbranded box!

I can tell you that i’ve listed products under my own brand that were by a different brand,
but in my case the original brand does not have their own EANs,
in the beginning we listed using the original brands name but then we had many other sellers tagging on and selling different brands or products that didn’t match, a couple years ago we could to a test purchase and then get them removed easily, it has now become harder for Amazon CS to listen or care even with all the proof you need so these other sellers continue to sell.
Giving us no choice but to list under our own name so we can stop those sellers.
But we do have blessing from the original brand and often we combine products so it’s unique to us
