After Letter Before Action

Hello,
I have sent a LBA to someone who owes me £2700.00 - My question is, can I proceed with the small claims court process meaning, filling out the forms etcetera so that I’m ready to roll when the 28 days are up.

First I do not think you had to allow them 28 days to respond. However as you have done, then only waiting the 28 days will you know whether you are spending money needlessly paying for the opening of an Online Claim.

Personally, I may be wrong, I do not think the LBA is a legal requirement to initiating a claim.

Normally 14 days is set as the reasonable time for the other party to respond, if you have stated 28 days, then you will need to wait until that deadline is up before pursuing a formal case via the small claims court.

As others point out, you may put your case at risk if you issue court papers within the 28 day deadline?

If short on patience, send a reminder after 14 days, may make you feel better :wink:
