I very much doubt it.
I have no idea what ex-Marks & Spencer means. Are they seconds? Have you bought them in a sale ? Unless you are an approved re-seller it is likely you will be challenged especially because you have cut the lables out. They are now no longer new with tags. I cannot see M & S being happy about what you propose let alone the buyers.
If they are your own unwanted clothes then you cannot sell them on Amazon because the clothing category you can only list them as new.
You need to tell us more about the source of the garments before anyone can offer you sensible advice.

If that was a condition of your purchase for resale, then I very much doubt you can reference M&S anywhere?

I’d check you conditions of purchase.
One of my friends has a market stall where he sells ex department store clothes including from M&S.
He’s not permitted to sell online anywhere and can only sell the clothing in a real world location such as a shop or market stall. Even then he’s not supposed to identify them by shop name even though he has a big sign saying ex-department store clothing.

Well this one has been happily working for you for a couple of years. That said, the ‘made up’ brand name is a definite issue, I really can’t see M&S being happy or Amazon if they looked closely.
There’s no mention of the tags being removed so why the need to brand them ‘ex Marks and Spencer’

>And not forgetting the Arsenic laden ‘magnetic’ putty. LOL
Now that is a cause for alarm … but I daresay the perceived racist ads will get more publicity

Clothing can only be sold in New condition on Amazon AFAIK

They are seconds, otherwise there is no requirement to cut out the labels.

I have considered this but I cannot afford to loose this listing.
It has over 154 customer reviews and it is #5 on “Amazon Bestsellers Rank” for Trousers.
Will Amazon allow me to change the brand name or is this not possible?

M&S have made a complaint to Amazon from what the OP states, I also read that the products are sold to resellers on condition that M&S branding is removed?
If branding is removed from a product, then offering M&S (or ex M&S) clothing risks claims of inauthentic if received by customers with no M&S branding, if advertised as a specific branded product.
