Item purchased by Competitior? To dispatch or not to dispatch?

A certain product I’m selling is sold by many sellers, one particular seller has purchased one of the items from me and has sent the below threatening message -

“Our request is: Take Down the product Immediately!!! And promise not to Follow our products in the future.
We will make at least 5 sample purchases for sellers who ignore our warning letter, in order to prepare for Test Buy and other matters. For sellers who neglect our warning letter, we will enter the complaint counterfeit and description non-conformity process immediately , and submit a series of complaint materials directly including Test Order to Amazon Copyright Team.
For the neglect of warning and mania followed our product, we will do the the direct test list and do not prompt anymore, until your account is blocked by Amazon, please believe that we have this ability!”

Any advice what I should do?

I have contacted Amazon and they have been no help. Simply said they could do nothing.

Do I dispatch this item?
Can this seller leave negative feedback even if I cancel this order?

Many Thanks

Does this seller own the brand/copyright of the item?

If Amazon aren’t willing to do anything, I’d personally mark it as cancelled by customer. Probably the best way to protect yourself. Quite disgusting that someone would even be so horrible to do something like that.

Report the message to Amazon. You are not permitted to send such messages using the Amazon messaging system. If the other seller wishes to raise a counterfeit and or copyright complaint that is their prerogative but they have to do it in the correct manner.

Yes they can. Though if they do I would raise a case with seller performance as it’s a violation to leave a competitor negative feedback with the sole intention to damage their seller account.

I would cancel the order. They probably want to do a test purchase to try and find something against you to report, even if they have to make up a lie. Cancel and don’t give them the oppertunity.

I find it quite incredible that Amazon are unwilling to do anything about this?

To get help and advice for this from Amazon, I went to -

Help > Get Support > Selling on Amazon > Other issues > Reporting listing abuse

Is there a better way to get help from Amazon?

This was the response I got, after asking for advice and whether or not to dispatch -
“We cannot take action on the report based on the information you provided”

This is what I call low level of threatening. Report this message to Amazon, dispatch your orders, competitors are bluffing.

What would happen if you reported the other seller’s product as counterfeit without resorting to the threats ? Just a thought

Without stooping to their level of threats, or fuss or drama, if feasible, buy 5 off them ? You don’t need to make any threats, they will understand 2 can play the game ?

Hi

Personally I would reply back ask the company to write to you on letterhead paper so you can seek legal advice on the matter. Just been reading about it on the internet.

Intellectual Property (Unjustified Threats) Act 2017

I just wanted to add we have a group of them at the moment playing silly buggers trying to damage our brand and reputation making bogus claims. We are advised to keep a log of this activity.
