Brand registry - loophole used by fraudulent sellers

Hello,

I sell ASINs of brands that are getting "highjacked" by sellers who are able to register the trademarks as their own brand.

The sellers then file IP complaints against all the sellers who are sourcing the genuine product from the manufacturers (including us).

I have already been victim of this scheme with 3 brands.

Such sellers manage to register the trademark in Brand Registry because they were able to register the brand with the IPO. It is incredible that the IPO does not check or did not realize that the brand belongs to a major Japanese company (with English language web presence).

The fraudulent IPO registration shows a PO box as address, fake looking names and a freemail email address.

The IP complaints in Amazon are coming from an obviously suspicious email address (a series of digits @ 163.com), instead of an official corporate email of the brand.

The trademark is actually owned by a large Japanese company headquartered in Japan (they have not registered their brand with UK IPO).

Their products are high quality, made in Japan, and are food-grade tested products. We buy the products directly from the manufacturer. The products shown on their official website match the information on the Amazon listing, including EAN and serial number.

This seller is now using the ASINs to sell low-quality counterfeit replicas and clients have already spotted the issue, with repeat buyer clients writing comments such as "Not as sturdy as the authentic product", or "flabby containers." There is a customer review titled "Can’t believe this is the same product" which includes comparative photos that show that the counterfeit version lacks the serial number on the lid.

Counterfeits are also lacking the original BPA-free, food-grade certifications, which raises potential health concerns.

The same seller has been observed selling other counterfeit items on their store, including a popular fake "gold" bracelet for 20AUD, which is a copy of the "LOVE" bracelet from a famous luxury French jewelry brand.

We have tried to alert Amazon, but they are taking no action. This loophole undermines genuine sellers and jeopardizes customer trust and safety.

Does anyone know what can be done in such a case?

Fake Reviews

We are being attacked by fake reviews and its damaging our brand and sales. Is there a way to request the fake reviews are deleted? We've tried reporting abuse and the fake reviews are still there.

ASIN in question is B0BVBTNRJT

We have two clearly fake reviews. Amazon please address this problem. Its worse than it has ever been.

Hi, we recently launched new colours for one of our products, but unfortunately, our Japanese reseller mistakenly set them up in Amazon first under an incorrectly worded brand name (they included Japanese wording in brackets).

For this reason we are unable to link them to our official brand or Amazon or set them up under the correct parent ASIN.

The reseller is willing to help but cannot edit the brand name themselves. We reported the listings as trademark violations, which led to them being removed/suspended. However, we’re now stuck because the EANs (which we registered through GS1) are still tied to the incorrect ASINs, preventing us from re-listing under the correct brand and parent ASIN.

We've tried seller central and brand registry support but no luck so hoping someone out there can suggest our next move!

Around 2 months ago we noticed that other sellers were coming onto our listing, fast forward today and there are 15 total new Chinese businesses selling on our ASIN.

The ASIN in question is the top selling product in its category, doing a lot of monthly sales.

The issue is that for this specific brand we never got any trademark, and as a result have no brand registry on Amazon for the brand.

The product is sourced from an Italian manufacturer and our company has the sole distribution rights for the brand in the UK, we wholesale it and sell it retail. All of these sellers that have come onto this listing are unknown to us.

We have placed a test buy from one of the Chinese sellers and confirmed that the product is not ours and is materially different.

I have tried to bring this to Amazons attention several times, through different methods, such as reporting it from the Amazon customer facing site, as well as making tickets through regular seller support.

The product is an automotive product, this product is produced to a strict standard, with a specific grade of metal - the counterfeits on our ASIN also pose a risk to the customers that purchase them.

We are now producing the product in question under another brand, and created a new ASIN to rival our old one (We will soon be out of stock of the original one). What gripes us, is when we sell out we will effectively have to compete against our own ASIN that should be dead in the water and not being sold anymore, but because of these Chinese counterfeiters we are now having to compete with our own work.

What can we possibly do at this stage? I have considered writing a letter to the Amazon legal team explaining the situation and informing them that the product is no longer made and anyone on the old ASIN is a counterfeiter putting customers at risk with un-tested, possibly sub-standard product. Would this be a suitable approach? At this stage we either want the ASIN closed as the product does not exist anymore when our stock runs out, or for all the other counterfeiters to be booted off the listing. What is the correct approach here, does anyone have any idea?

Handmade listings no longer linking to Store

I have a Handmade brand waiver and have had an Amazon store for 2 years - my listings have been linked to it for all that time. But I have noticed that my listings no longer link to my store.

I have created a case to ask why, but just keep getting the following random answer:

'Thank you for your report of a suspected policy violation. We cannot take action on the report as no violation has been identified on the reported ASIN for the violation type selected.'

I have asked my question 4 times, saying that my question is NOT about a listing violation and got this same irrelevant response every time.

The query I sent is below. Does anyone know how to get a relevant answer?

I have noticed that on my listings, there is no longer a link to my store, just a link to a search page

How do I reinstate the link to my store?

Hi there,

Has anyone had experience with Amazon not reviewing a selling application for a brand at all? I've had a case go past the date by about a week and this is the second time.

It's for one particular brand so not sure whether it's anything to do with that.

We have a large amount of stock stuck in stranded so it's becoming a bit concerning our end.

Brand disappeared from brand registry account

Hi,

I had a registered brand in the UK that disappeared at some point from my brand registry account. Even though the brand disappeared, I could access the brand benefits such as brand analytics and Video Ads in Seller Central.

To resolve the matter, I raised a case (9289383522) with support. After back and forth for over 6 months with support to explain my issue, I was told that when I log into my brand registry account, I end up logging in with a merchant token with which my brand was not registered. I asked support to merge the merchant tokens with my brand registry account so that I can view it but I was told that it was not possible. As a solution, I was suggested to get my registered brand removed and apply for brand registry again.

I agreed to have my brand removed and applied again. However, my application and subsequent appeal were rejected. So now, while trying to make my brand visible in the brand registry account, I've lost access to my brand benefits without really understanding why my application was rejected for a brand which was already registered and was removed on support's advice.

Can someone help me with this please? Thanks.

We have been experiencing an error message on the backside of our listings

If you are the brand owner, please make sure that you’re registered in Brand Registry and this ASIN is registered to your brand.

We are brand registered as the brand owner, the EANs are GS1 registered to us. We have sent screenshots from brand registry showing the trademark information, etc

The case has been open 11 days, they "have requested our internal teams for the updates"

We need to be able to control OUR listings so they can be updated with the correct product information. Any suggestions on how to move case ID 10406770832 to a positive resolution?
