Small claims court for an order made on Amazon DE
I am (was) a UK based seller and there was a scam order for a decent amount that was placed on Amazon DE website. Amazon has sided with buyer with some ridiculous excuse and appealing that doesn’t work. Basically nothing new here. I’m planning a Small Claims Court claim but unsure if this will be should go to Amazon UK where I’m registered or Amazon DE. Probably the former but would be good to know if anyone had a similar experience.

Thank you @DVT, @BM5, @Blackadder and @Silhouette_Fashions1 for useful tips and ideas. I’m sure it’ll help to get me started. This topic can be closed now.

I think that you need to give some more details in order for anyone to give you some advice.
What was the problem with the order? Did it not arrive? Do you not have proof of delivery? etc

First question - did you send it fully tracked, DDP with an approved courier ?

Sent a €700 item from an official distributor’s warehouse to a German address. The buyer claimed “it was a brick”, took pictures of some cheaper chinese item not even similar to what I sold. Delivered in time, fully tracked of course. Got a 100% proof that the correct item was sent. When they claimed it was a “wrong item” I consulted literally every single step with Amazon Seller support before doing anything but still ended up with a A-to-z which was lost and appeal was lost as well. But all it that matters very little now since it’s a “it’s Amazon” case. Nothing helps, just planning my next steps at the moment.

Just not selling anymore. Was dropshipping. It was a cheap chinese item of similar functionality and took pictures of it. @DVT is correct, none of that matters anymore.
I’ve tried reaching managingdirector@amazon.co.uk and managingdirector@amazon.de, as well as Ralph Kleber who is supposed to be DE country manager. Dropped an email to Jeff as well but was really hoping a Managing Director will get back to me as my case is quite ridiculous and was handled by scripts rather than people.

I can because the item was sent from a place that only ships their brand items. Of course that doesn’t really prove anything in the end but then nothing does, actually. Pursuing the buyer on Amazon platform doesn’t sound like a good idea to me, to be honest.

Amazon knowingly sided with the buyer and is now involved in fraud. Usually they will refund you when you appeal your case and have valid proof but this time they came up with an arbitrary reason not to (invalid returns address, which is valid btw).

Hi
Have you informed your courier? The customs declaration will confirm what was dispatched together with the weight amount etc. Also duty will need to be paid on product if the order value is £700. Who did the customs ? If the packaging shows signs of damage this information is recorded at customs.
If the buyer claims they received something different from what was ordered ask the customer to provide you with information which will then form a part of your investigation.
Was your order delivered to a PO Box address? If so it sounds like an issue I had few years ago.

Also I am surprised the fraud took place on this platform yet you have no support.

We had the same thing. German customer didnt like the £400 item and so amazon just gave them the money back?? We wanted to take them to small claims court as well but wasnt sure if it was possible being Germany.

Be also aware, that the problem may be on the carrier side, I had situation, using Fedex, had some reports that parcels arrived to the destination with the fewer items inside . But once, by acciden, parcel posted to the USA with 4 items inside, were returned to me, inside was only 2 items and paper in the place of 2 items.
