I have been pondering this question for years. I understand we sell on their platform and must obey the Amazon God's and their often ludicrous policies, but for all the ease of fraud being committed due to their policies and systems, are they liable as much as the customer for acts of fraudulent activity ?
I've seen it asked a number of times, we are not allowed to take Amazon to court for fraudulent claims being utilized by the A-Z system and lack of maintaining or administering their own policies and rules, why don't more people take them to court and challenge their policies. They have to obey the rules of the land and the laws in place. They are after all, just a shop. Why don't we all join hands, take all our evidence with us and sue them for losses over the years? What would the outcome be, the courts force amazon to refund our losses and change the systems? the A-Z system really needs to go like most of seller support too.
Non delivery claims, whilst some will be genuine, we all know the scams and easy way to get free products against marketplace sellers (facebook groups for example)- i make that point, because if you do it to amazon supplied products, they are never quick to refund you from their purses and make you jump through hoops first. From us poor sellers, straight away usually.

You can take legal action against Amazon this is not prohibited and many sellers get claims settled this way for A-Z's unfairly awarded.
Taking legal action against a customer who has won an A-Z breaks Amazon's T&C's. This could result in action against your account, anything from a warning to deactivation. You can if you wish take action against the customer but you should keep in mind the possible impact on your account.
Obviously every seller should evaluate whether they should take legal action. I personally do not but that is mostly because my items are low value and not worth the hassle of taking further.

If a court awards the case to you, the solicitors organise a payment direct to a bank account nominated by you.
