Is GPSR necessary?

Can anyone please confirm that we do NOT need GPSR if we only sell in UK?

(We do not wish to sell in EU)

I contacted SS a while back & they confirmed sales to NI can be 'switched off' for FBA & FBM, but I am now hearing different - Our NI sales are very small so we wouldn't be affected too much..

Officially, we only have the GPSR Policy page to refer to.

This states..

"The GPSR will not apply in Great Britain (England, Scotland and Wales). It will, however, apply in Northern Ireland, under the Northern Ireland Protocol"

But then goes onto state...

"For listings on our UK-based store, you don’t need to submit any information to Amazon"

Obviously, with Northern Ireland being in the UK, those two statements contradict each other and by the EUs ruling, if you have a listing with the ability for it to be delivered to Northern Ireland, you must comply with the GPSR policy. So, manufacturer details should be on the listing or an EU/NI based responsible person.

Seller Support won't have a clue in all honesty - given the policy page states that.

Provided you are on the Professional Selling plan you CAN turn off the ability to delivery to NI. You can't do this as it stands with FBA or SFP offerings. But then of course, amazon state it doesn't matter as you don't need to supply any information on Amazon UK.

If you sell in the UK only then GPSR is not required. However if you sell to NI then yes it is required. I am switching off NI at the start of December as it is not worth the hassle for so few orders anyway.

Thank you for posting a very good question. We are aware of the fact that sellers are confused. We have received a more detailed explanation from the partner team, which I am sharing below:

Under GPSR, it's important to look at "the order creation country" not the destination country as order creation country indicates where listing takes place. UK is not a part of EU therefore if the order is created on amazon.co.uk and sent to Northern Ireland, that order doesn't need to comply with GPSR. If the order has been created in any other Amazon EU Marketplace and sent to NI, those listings will need to comply with GPSR regulations.

As an example, when you buy a phone charger at UK airport during your transit flight and you take the charger back to your home in Germany. You can not expect that charger to be complying with EU regulations.
