Policy Warning: trademark infringement Address or Let it go?

Hi there! We have been selling since 2012 and we have not dealt with this issue before. We sell a similar product to another company but we sell on our own listings. However we have recieved a few mislabeled competitors stock from Amazon returns and had it listed properly on the competitors listing. Since we have been selling since 2012 the risk is not worth it for 4 units and a sales rank in the 6 digits. We have deleted the listings to show we have no further intent to sell. I am unsure why we are receiving this notice since we did not create the listing to put any copywritten information in it but thats besides the point. From reading on the forums it is better to say your sorry and delete the listings. However in the auto reply it states that deleting the ASIN doesn't remove the complaint? We since there are no invoices available, no retraction is available? I suppose I could take a photo of the competitors Amazon removed authentic stock with the Amazon removal stickers maybe they can look at the ARN number? An invoice should only be required if selling NEW stock. I know his and have it listed as used. Infringement type: Counterfeit

Hello,

We are contacting you because we received a report of trademark infringement on the product detail page associated with one or more of your listings. Sellers on Amazon.com are not allowed to use trademarked terms in a way that might lead their product to be confused with a different trademarked product.

Please modify your product and product detail page to ensure they do not infringe on the trademark of the rights owner listed below. Once this is done, email us at notice-dispute@amazon.com>.

Examples of unacceptable terms:

-- "AmazonBasics speaker charging cable." AmazonBasics is trademarked by Amazon.

-- “Wireless Amazon speaker for laptop.” Amazon is trademarked by Amazon.

-- “Cable similar to Pinzon.” Pinzon is trademarked by Amazon, and we prohibit the use of “similar to.”

Examples of acceptable terms:

-- "Cable for charging AmazonBasics speaker." The cable is not created or sold by Amazon.

-- “Wireless speaker for laptop, compatible with AmazonBasics.” The speaker is not created by Amazon.

-- “Basic cable works with Pinzon.” The cable is not sold or created by Pinzon.

If you do not provide the information within 90 days, you will receive a request to remove the inventory associated with these listing per our removal policy. Failure to address this request can lead to destruction of your inventory.

If you believe your listing was removed in error, you may email notice-dispute@amazon.com with supporting documentation (e.g., letter of authorization, licensing agreement).

We consider intellectual property infringement a serious matter. If we receive more complaints about your listings, we may not allow you to sell on Amazon.com.

We may restore this content if the rights owner who reported this infringement contacts notice-dispute@amazon.com to retract the claim. The rights owner contact information can be found below.

-----------------------

Hello,

We received your submission but do not have enough information to reactivate your listing currently. To reactivate your listing, provide any one of the following documents for proving the authenticity of your listings:

A. A letter of authorization or a licensing agreement from the rights owner demonstrating that you possess the right to use the content claimed. The documentation submitted must meet the following criteria:

-- The document includes the name and address of the rights owner.

-- The document includes your name and address, matching the information in your selling account.

-- The document explicitly authorizes you to use the rights owner's intellectual property with your own brand name.

B. An invoice to show that your products are original and are purchased from the rights owners directly or from an authorized distributor and are not infringing the trademark claimed by the rights owner. The documentation submitted must meet the following criteria:

-- Dated before the date of your notice.

-- Includes your name and address, matching the information in your selling account.

-- Includes the name and address of the manufacturer, distributor, or retailer.

-- Order quantity is sufficient to fulfill the units sold since the invoice date.

C. A retraction from the rights owner to be sent to Amazon directly. You can find the contact information of the rights owner in the listing deactivation communication you have received.

You can find the contact information of the rights owner at the bottom of this message.

Has your listing been deactivated in error?

If you believe that there has been an error, tell us why. Your explanation should include how your listings have not violated the brand's intellectual property along with documents mentioned earlier to support their authenticity.

How do I send this information?

If you are appealing an action we have taken on your listings for an intellectual property complaint, go to Received Intellectual Property Complaints in the Product Policy Compliance section on Account Health:

url

Locate the deactivation record for the product listings that you want to appeal and click on the Appeal button next to the record to submit your appeal to reactivate your listings. If you want to submit additional information, click on the "View appeal" button next to the deactivation record. To submit information necessary to reactivate your listings, click the "Submit additional information" button.

What happens if I do not provide the requested information?

If we do not receive the required information, the listing will remain deactivated. The violation record will remain on your Account Health page for up to 180 days after the listing was deactivated or until the violation is successfully disputed. Deleting your listing on this ASIN does not sufficiently address the reason for the violation and will not result in its removal from your Account Health page.

Thank you for the information provided regarding the recent trademark concerns that have come up with your listing. I understand you received a complaint on a listing regarding the use of another trademark, but the attempts to address it have been unsuccessful. I know this can be increasingly frustrating, and I do want to get you the support needed to move forward.

You mention having attempted to provide documentation, could you clarify what all you have attempted to provide for review? The messaging seems to mention a rights owner, have you attempted to get the retraction? I do want to better understand where you are in this process so that I can get you accurate next steps for how to proceed.

I will continue to monitor this thread, and encourage you to refer here for any additional details you would like to share for review.

Best,

Atlas
