I am seeking advice and support to resolve a Trademark Text Misuse notice issued to my account on November 26. I would greatly appreciate any guidance from experienced sellers or Amazon support representatives regarding the situation. Here are the key details and questions:
Background:
I received a Trademark Text Misuse notice for allegedly infringing the FRONTLINE trademark.
The notice affected the following ASINs: B09WKWQCR7, B09Y4NYWSX, B09Z9RYVV5, B09WKGGQKS, B09Y4N7KF1, B0B42M7NB2, B09Y4QDRSH, B09Y4NJQ36, B0B42LH62Y.
Of these listings, only two (B0B42M7NB2 and B0B42LH62Y) sell FRONTLINE-branded merchandise. The rest sell products under the Beaphar brand.
Observations:
All the affected listings have "Pet Bazaar" listed in the brand column, despite selling products from different brands (FRONTLINE and Beaphar).
The real trademark owner of Pet Bazaar appears unrelated to both FRONTLINE and Beaphar brands.
And this company remains active on these listings, suggesting potential misuse or manipulation to remove competition.
Key Concerns and Questions:
Notice Validity:
How did I receive a Trademark Text Misuse notice for listings where the FRONTLINE trademark is not directly or indirectly mentioned?
Could the issue stem from misbranding in the "brand" column of these listings?
Appeal Process:
If Amazon requests a Letter of Authorization or invoices for the affected listings, we can only provide documents for Beaphar products (the actual goods sold).
How should we appeal this notice, given the listings mistakenly associate with the FRONTLINE trademark or "Pet Bazaar"?
Amazon’s Role in Corrections:
As we are not the creators of these listings, we cannot make corrections to the brand column. Can Amazon proactively update the brand column to reflect the accurate trademark owner (FRONTLINE or Beaphar)?
I believe this situation may involve deliberate misbranding by the listing creator to exploit trademarks and eliminate competition. Any advice on how to approach this matter effectively, particularly with Amazon support, would be immensely helpful.
Thank you for your assistance!
