Listing Blocked - used sold as new- Appeal Help
Could you please give me some advice about appealing blocked product ?
Reason : Used sold as new
We are manufacturer and the brand owner of cosmetic gel.
One of our customers complained that he has received used bottle of gel.
Asin was fullfiled by us and Amazon - I have no idea what sort of fulfillment was used for this particular order.
Amazon blocked the ASIN.
This is my appeal :

I am writing in regards to recent blocking of our listing for the product: ABC , ASIN: ABC
As I learned from your report, there was a customer complain, who received used product instead of new. I have investigated and analysed all the possibilities how the problem have occurred and have tracked our supply chain for the possible mix up.
We are using FBA service and also fulfill items by ourselves.
POSSIBLE CAUSE: Items might have been mixed up in FBA centre when accepting customer returns and used item was classified as in sealable condition instead of damaged /unsellable.
SOLUTION: We have applied permanent seal to the packaging to avoid possible mix up when dealing with customer returns in FBA. The seal will need to be destroyed when unpacking the product so it will be clearly visible in the case the item will be returned by customer to FBA centre.
POSSIBLE CAUSE: Used or faulty items were send to FBA centre.
SOLUTION 1: We have implemented a new Quality Control procedure to double-check each and every product before shipment is made to FBA centre, to ensure that every single item is properly inspected for any faults and the presence of permanent seal.
SOLUTION 2: We will be disposing of all returned items immediately from now on, to ensure that no mixing of new and used items occur in the future.
POSSIBLE CAUSE: Item was fulfilled directly by our site and we have send customer return as new item to the new customer.

POSSIBLE CAUSE: Faulty item arrived from the production line and the bottle was not filled up to the top.
SOLUTION: Additional working associate will inspect all the incoming stock from production line and check it for any faults.
POSSIBLE CAUSE: Item fulfilled by us might have been damaged during the transit and customer regarded this as in used condition.
SOLUTION: We have implemented new secure and shock resistant type of packaging to make sure that no item will be damaged during the shipment.
I would be grateful if you could remove selling restriction. We believe that we already have appropriate policy in place, and with additional processes above we will prevent similar problems in the future.

Have you tracked any feedback to see if you can identify the order and determine if it was FBA or not? You have to wonder if it was an FBA return that got incorrectly added back to inventory. Can you audit all FBA returns and see if this product has ever been returned?

I have checked all the returns from last year - I can not find anybody who was complaining about condition of the product…
There is also nothing in last year customer feedback.

We are facing the same problem. We have been selling on Amazon for 7 years and have never had a complaint. Suddenly, we received two complaints last week and our ASIN is suspended. Amazon is getting worse by the day

You can’t set all returns to be sent back to you, somebody who is in the warehouse decides to put returned item back in stock. What seller would try to sell used item as new anyway knowing the panalties? We are being punished for someone else’s mistakes.

Adrian, this option does not exists and we asked Amazon about this, you can remove unfulfillable items only, if someone decides differently, it goes back to stock

Last week Amazon made these types of complaints more visible, causing a lot of older ones to randomly begin showing up on peoples’ accounts. As such this might not be a new complaint (check the date on it), if it’s an old complaint it will be extremely hard to appeal.
You could contact Amazon and request more information about the complaint.
Sometimes customers report items that are damaged in transit as “obviously used”, which will trigger this type of complaint to be processed.
