Received Intellectual Property Complaint, Trademark Mentioned in Customer Reviews
@Dougal_Amazon
I've read through the forums and I saw that you help people with intellectual property violations. I'm hoping you can assist me with a situation I'm currently facing.
I need help with responding to Amazon about an intellectual property violation that we recently received on our account. I reached out to Account Health twice and Seller Support and I am getting conflicting information.
Here's the situation:
We sell a product that is not directly associated with Harry Potter or any of its trademarks. However, many of our customer reviews mention Harry Potter in relation to our product. It seems that this association in the reviews has triggered an intellectual property violation notice.
Can you please look into this? I'd appreciate any guidance on how to navigate the issue.

Here is the issue...
If I search Amazon for "Harry potter Trunk" 7 of your trunks show up on the first page. Several promoted listings.
How come?

Hi @Seller_dtFJ0Rngy1vPO,
Dougal from the Community Manager Team here and thanks for the challenge....
I was able to find the performance notification and Account Health violation and after some additional research I was able to find an escalation path.
Your situation is pretty unique. The details provided by the complainant did lead me to think this may not be a valid IP violation so I utilized that escalation path to request additional research be done on your issue.
I am not super familiar with the response time for this team and I will let you know as soon as I receive a response, but feel free to check back in with me after 5 business days for a status update.
Best, Dougal

95% of all the Intellectual Property Complaints are horse poop! We get them all the time and Amazon attacks the seller that has nothing to do with their incorrect issue and tells you to edit listing to remove the issue that never existed nor caused by you. We have one item that they claim Captain America miss use while actual listing has nothing to do with Captain America and there is now way to inform Amazon they are wrong. We look at issues like this and think Amazon clearly does not want sale of this item so we sell that item elsewhere.

Hi @Seller_dtFJ0Rngy1vPO,
Quick update heading into the weekend, my internal escalation was closed and I was directed to another path/team which I have already submitted, but as I have been digging further into this I am curious what you have already submitted to account health. FYI, I can see their response and I see that you provided a link, but I do not have the access levels to review attachments for Account Health correspondance. So here's the question, Have you provided the level of detail to Account Health that you provided here? Meaning, have you directed their attention that the verbiage in the IP complaint states use of the TM'ed term in reviews, but NOT the actual listing?
If you have, let me know, but if not it is worth a shot to get that on an official submission. This may also help my new escalation so if you have already done this, please point me to a case ID or performance notification where Account Health has reviewed and then rejected that explanation.
Thank you,
Dougal

I have been selling DVD's and music on Amazon for 15 years , and suddenly received notice that any title with the word sex was being taken down , violation of nothing, violation of this and that and the only person who keeps feeling violated is me,
