Brand Registry revoked for reporting counterfeit sellers

My brand registry was recently revoked for "policy violations". I reported a few different sellers on my listing using the Report a Violation tool and provided my Order IDs, photos of the counterfeit products (which were horrible quality - leads to poor customer experience as they were expecting my high quality product). This is objectively the right thing to do. I'm not sure what happened but Amazon said I abused the tool.

I've tried appealing and have gotten rejected 2 or 3 times. I submitted an appeal yesterday trying to fall on the sword and tell Amazon that I won't do whatever I did again (13826883511) and it is Pending Amazon Action.

This is going to ruin my Q4 as I have multiple SKUs with a lot of inventory that I can't create a listing under my brand name. I don't want to list as Generic because that will be a big headache in the future.

@Amazon can you please help? Somehow I am the victim of counterfeit sellers on my listing and now Amazon penalizing me for reporting them.

@Anyone else - Any tips on how to get the appeal accepted? Appreciate any help!!

Unfortunately, this is how Amazon resolve the issue. They stop the selling of the product. this is nothing new.

"I've tried appealing and have gotten rejected 2 or 3 times".

Amazon only wants to see that you are the Actual Owner of the branded product, and the Brand name.

"I don't want to list as Generic because that will be a big headache in the future".

Selling a product and using the word Generic as a brand is rather foolish. Generic is not a brand, it is a word that means similar to the real thing, but not the real thing. Now what does that say about your product. It tells the buyer your product is not the real thing but a copy or knockoff. Sort of a poor way to start a business.

Do you know how retailers work with manufacturers? Generic products you are talking about are made specifically with no brand name on them, (Generic). They are made for retail stores, like you, to purchase and place their own name/brand on them. This can either be done at the factory or done in your own place of business.

Here is an example. Walmart and Target each purchase 10,000 of the same generic product from the manufacturer. They come with no UPC. When received, Walmart places its GS1 UPC on their shipment, and Target does the same. When the items are scanned at Walmart and/or Target, everything works just fine, and the single unit is deducted from inventory. NOW…When the Walmart buyer tries to return the same item to Target to get a larger refund, the product is rejected as not being sold by Target.

Now even amazon knows how this works. Amazon owns 100+ brands it sells on the site which are actually Generic products just labeled with different brand names they created. Maybe Amazon thinks it is time for you to do the same.

If you have a registered trademark contact your attorney and file a lawsuit against the offending sellers and Amazon as their enabler.

The arbitration clause cannot supersede your rights as a trademark holder to seek redress in court.

If you do not have a trademark and the brand is "registered" to you then file for arbitration.

This is really absurd when you report the counterfeit seller and you got banned from brand registry.

I have the same issue here and never successfully appealed.

It's been a while since my brand was suddenly removed as well. I've appealed about 5 times and haven't been successful yet. I'm still appealing. I hope you can be successful and good luck!

Amazon is full of fake brands. They, amazon does not know fake from real anymore. There is a 1 or two year wait for the official trademark. In the meantime, amazon jumps the gun and accepts your application. Now all the fakes are being blamed on lawyers that have done nothing wrong except gaming amazons inept branding process. Everyone pays the price.

Amazon makes Billions on Knockoffs. Any item manufactured anywhere can be duplicated. Without counterfeits they will go belly-up.

I'll never understand why Amazon started their own "branding process". Made no sense to me and just created a nightmare. They allow ANYONE to brand ANYTHING. How many American flags are "branded" on Amazon. Lots of items branded on here are NOT in fact branded. They are "branded" on Amazon, no where else as the "brands" literally brand ANY item as their own brand, which is not the case at all. It is only branded here on Amazon to avoid people highjacking listings. That's the ONLY reason I can think of that Amazon "made up" their branding process. Many brands here have branded products they know they own in no way, just to list on here. It was a long drawn out process to even get legally branded with a trademark. Amazon has made selling a nightmare for the last 20 years. You could ONLY list with expensive barcodes I had to waste money on, and ONLY needed em on Amazon. Then they switched to the branding crap instead of the barcodes, again, the "brand" only helped on here and no other venue we sell on. It is EASY to list on other venues, EASY to have sales, and none of the AI bots drama weekly like we go through on here. It seems Amazon doesn't even want sellers. I didn't need to go to a university to list elsewhere. It was beyond easy. Amazon should have the best platform to list on with as much money as they screw sellers out of, but the dashboard, listing, and advertising on here is a nightmare. Totally uncalled for. I'll never understand why I have to go through so much just to sell on here. It's on purpose for sure.

Dougal from the Community Manager Team here and I responded to a similar POST from you just last week.

Thank you for providing a case ID to review. Brand Registry typically does not disclose a lot of information around the removal reason as per their policy. However, I have worked on many seller cases with Brand Registry here and have some insights/ potential reasons that may help.

Typically when sellers receive this messaging it could mean 2 things:

  1. The seller themselves has engaged in abusive conduct
  2. The trademark/brand is abusive.

For 1. If sellers have been selling for awhile, some sellers will have Account Health metrics they will need to work on, or have other selling accounts they opened in the past/present that in bad standing. (deactivated, terminated, not meeting account health metrics, unresolved claims, etc.)

If you are a new seller and do not fall under all things listed in 1, the reason for decline could be for reason 2.

For 2. Trademark reason, if sellers are working with an attorney or agent that violates United States Patent and Trademark Office (USPTO) rules and policies, this will prevent you from enrolling in Brand Registry.

If you’re working through an intermediary, rather than directly with a U.S. licensed attorney, to seek a U.S. trademark registration or enrollment into Brand Registry, your application may be subject to additional investigation by Amazon and the USPTO.

Please check whether your attorney is a subject to an Order for Sanctions from the USPTO or listed on Potentially Misleading Solicitations. If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a new private U.S. attorney to review your application.

If you review 2 and are sure that your attorney is not sanctioned by USPTO or Amazon, please appeal your case and apply again.

Amazon has made selling a nightmare for the last 20 years. You could ONLY list with expensive barcodes I had to waste money on, and ONLY needed em on Amazon. Then they switched to the branding crap instead of the barcodes, again, the "brand" only helped on here and no other venue we sell on. It is EASY to list on other venues, EASY to have sales, and none of the AI bots drama weekly like we go through on here. It seems Amazon doesn't even want sellers. I didn't need to go to a university to list elsewhere. It was beyond easy. Amazon should have the best platform to list on with as much money as they screw sellers out of, but the dashboard, listing, and advertising on here is a nightmare. Totally uncalled for. I'll never understand why I have to go through so much just to sell on here. It's on purpose for sure.

Dougal from the Community Manager Team here and I responded to a similar POST from you just last week.

Thank you for providing a case ID to review. Brand Registry typically does not disclose a lot of information around the removal reason as per their policy. However, I have worked on many seller cases with Brand Registry here and have some insights/ potential reasons that may help.

Typically when sellers receive this messaging it could mean 2 things:

  1. The seller themselves has engaged in abusive conduct
  2. The trademark/brand is abusive.

For 1. If sellers have been selling for awhile, some sellers will have Account Health metrics they will need to work on, or have other selling accounts they opened in the past/present that in bad standing. (deactivated, terminated, not meeting account health metrics, unresolved claims, etc.)

If you are a new seller and do not fall under all things listed in 1, the reason for decline could be for reason 2.

For 2. Trademark reason, if sellers are working with an attorney or agent that violates United States Patent and Trademark Office (USPTO) rules and policies, this will prevent you from enrolling in Brand Registry.

If you’re working through an intermediary, rather than directly with a U.S. licensed attorney, to seek a U.S. trademark registration or enrollment into Brand Registry, your application may be subject to additional investigation by Amazon and the USPTO.

Please check whether your attorney is a subject to an Order for Sanctions from the USPTO or listed on Potentially Misleading Solicitations. If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a new private U.S. attorney to review your application.

If you review 2 and are sure that your attorney is not sanctioned by USPTO or Amazon, please appeal your case and apply again.
