Intellectual property complaint
Hi,
We sell our own branded goods. This morning we had noticed two of our products, which are both variations, had the word “inactive blocked” next to them on our EU inventory. The products are both still active on our UK inventory. We have had no notifications or emails from Amazon about this. Phoned seller support and they were unsure what the issue was. I then happened to click on account health and it states that I have had two intellectual property complaints relating to the two variations in question. There is a button to appeal but no further information about what the complaint was about or who made the complaint.
Any idea what I should do? Thanks

Even if you haven’t received any performance notification or further information about who complained, you can still easily appeal and have your listings reinstated.
If you are confident that the complaint is false, you can dispute it by providing Amazon the proof of authenticity.
Amazon will only accept receipts and invoices which clearly display all of the following:
Supplier information (name, phone number, address, website)
– Buyer information (name, phone number, address, website)
– Item descriptions (matching the ASIN(/s)
– Item quantities (should reflect your selling volume)
– Invoice date (must be issued in the last 365 days)
It must clearly prove that your products do not infringe on the intellectual property of the rights owner. Send this information, any other documentation, and a list of impacted ASINs to notice-dispute@amazon.co.uk.

Yes there is a different email address for each country. Will the invoices help with an IP appeal or will they just show the products are authentic?
Strange thing is that it has not effected our UK listings nor has it effected other products we sell on the EU with the same brand

So I sent the invoices and this is the reply I have received:

– Proof of product authenticity (e.g., invoice, Order ID, licensing agreement, letter of authorization). It must clearly prove that your products do not infringe any intellectual property rights. Please send this information, any other documentation, and a list of impacted ASINs to notice-dispute@amazon.es
– Greater detail on the root cause(s) of the infringement.
– Greater detail on the actions you have taken to resolve policy issues.
– Greater detail on the steps you have taken to prevent infringement going forward.
– Greater detail on why you believe an error has occurred.
Any ideas on next steps?

On the response from France they have included details of the supposed rights owner - a company named schreiberhahn.
Has anyone come across this company before? They have included an email address so I am going to email them and find out what the issues is, hopefully they will reply.

I have further information from the support team. They have provided another ASIN from another seller who has also been reported for violation. This product is a similar type of product to ours. I am now assuming that they have reported us for design rights. However this is a product design of which there are 1000’s currently for sale on Amazon.
Does anybody have an appeal template for appealing a design infringement?

“Thanks for your message. We are currently unable to accept your appeal because we were unable to identify the claim report in question” Please send us the claim report ID"
LOL I do not have the claim report ID I have had no notifications at all.
So Italy have suspended the listing but they don’t actually know why

I have now had further information from Amazon regarding the infringement.
The infringement relates to:
“Copyright - unauthorised use of copyrighted material such as text, photos, videos, music, software”
The item is not video music or software so the infringement must relate to text and / or photos
What can I send to Amazon to prove that the photos and text have not been stolen? I have invoices from my photographer, and invoices from the translation company who translated the listings.
