Please help. Blocked listing due to multiple reports

Hello. I have a problem with a blocked listing due to multiple reports from the fake brand owner. I already sent 200 items for FBA because I could do so and I did not need approval to sell this item. After I sent my units he started reporting me and no matter my appeals, Amazon just wont consider my invoice as a proof (no matter I sent the same invoice to apply for a few other items and they were approved). I also contacted the manufacturer for the UK and asked them for approval, they sent me an document that they confirm I have a permission to sell the product and that they dont have any contracts with other sellers on Amazon. The thing is the product is literally the same, I have ordered it from the other seller and it is exactly the same product, but he put another brand name and now I cant create a removal order to return my 200 items back. I have reported that there is a matching listing for the same product and it is from the same seller as well under another brand. I have ordered from this listing too. Same product. So my question is - did anybody have similar problem and do you think it is best to report the seller that he is selling an item under a fake brand (which I dont really want to do) or does anyone has any idea how I can return my items back because I don`t want them to be destroyed as they are literally genuine. Thank you to those who are willing to help.

P.S. After speaking with the person and asked him nicely many times to approve my application so I can create a removal order, he was just not nice.

The actions that Amazon have taken are correct. The product may well be identical but if it is listed under the wrong brand then you are likely to be kicked off the listing and any FBA stock will not be returned to you and will be destroyed.

The brand name on the listing is likely to be someone’s trademark and you can’t list against it without their permission. If you do list against it without their permission you can end up with an inauthentic item claim.

There is very little you can do about this. The actual brand owner may well be able to take action against this seller if they do not allow their products to be rebranded. However even if they do this it will have no impact on you.

I understand that you received a counterfeit without a test buy complaint from a rights owner.

In short, we operate off the assumption that if you add your offer to a detail page or create a new listing, that you are authorized to use any of the intellectual property therein.

The guidelines to source products to sell on Amazon is an good resource when researching this type of information and will help differentiate between being authorized to use someone’s intellectual property and being approved to sell that item on Amazon. Those two things are not the same. If you are approved to sell this brand on our platform then you are half way there, you will also then need approval from the brand itself to sell their item.

Additionally, purchasing your items from Marshall’s and then reselling them is considered retail arbitrage. While this is not expressly against policy, you will run into issues if you are required to submit documentation. A receipt from a retail store will not provide evidence that you are authorized to sell the item, nor will it meet the invoice requirements listed below.

  • Issued in the last 365 days.
  • Reflects sales volume during that time.
  • Includes contact information for both the supplier and the buyer (name, phone number, address and website).
  • Be unaltered (pricing information can be redacted).

Note: Your details as the purchaser should be verifiable with your Amazon selling account and any discrepancies or incomplete info can lead to documents getting rejected.

If your invoices are not getting accepted, then the only option available to you is a plan of action where you address the possible misses that must have triggered the violation and add a note that you have tried providing invoices but they were not accepted.
