Taking Amazon to small claims court

Hello , i am a UK amazon seller.
During lockdown I bought goods from a phone shop that wanted to liquidate his stock and he gave me a receipt .
I sent the stock into Amazon .

  1. Tracking says it was delivered
    2)Received Inventory shows the correct amount was sent .
  2. daily inventory report shows that the stock went missing on 27th Feb.
  3. Amazon themselves said they can’t fins in warehouse and want a invoice .
  4. I sent the receipt.
    I have pictures of the labelled products and a picture with my ID card .
    They say receiot is not good enough and will not reimburse me 8k worth of stock because I dont have a invoive .
    No highstreet shops in the uk give invoices.
    Do I have a chance in small claims court as the system shows it was recejved by amazon and they have indirectly said they have lost it.

Unfortunately amazon don’t accept retail receipts for goods sold as 'new

Yes, you would win in court. However as (lots) of sellers will be along to tell you, retail arbitrage is not allowed on Amazon. Just remember that as Amazon booked the stock on and then lost it, that’s all that will matter to the courts. Amazon policy with regards to invoice vs receipt will stand for nowt.

It’s an interesting one. I have sent Amazon a retail receipt before in order to claim the value of an item they damaged. They accepted it, though of course it was nowhere near being £8k. How detailed is your receipt - is it fully itemised and each item clearly identifiable?

Do you have the stamped BOL as well as it saying delivered online as you need that for it to count as delivered?

Can you go back to the Company you purchased from, ask them for a proper Invoice (typed up), needs to show their official Company name and business address (+ phone number, so Amazon can phone them to verify).

Showing each item and the quantity (1 per line like usual trade invoices, not as a total sum).

If they were an authorised trade distributor as well as retail, as them to ensure that is showing on their invoice.

As the others have said, really this was a shop closing down, so retail, should not have been sold ‘new’ on FBA, it is only counted as ‘used’

As the larger amount though, then you can argue this was Trade Distribution, although Amazon argue as to who is a Distributor, if approved by the makers or not.

You may need to get the address for legal action, but I think it is: Amazon UK, 1 Principal Place, Worship Street, London, EC2A 2FA

Point being, Amazon are not disputing that they received the goods. Open and shut case.

You will need to take them to the Big Claims Court… and make sure your get your monies worth.

Even if you bought it from shop as personal customer, considering amount of sale, it would hardly classify as a personal purchase in my opinion. In that case unfortunately, you should request invoice with seller info as a business at the time. I guess court would be on your side as it shows as delivered. Amazon might claim it’s a breach of contract as it is non-business purchase you made to sell on here as a business, however court should be on your side as it’s goods you shipped to them and they lost it within their network. They should refund in my opinion, like if you accidentally send them £1000 cash in envelope and they will lose it, it doesn’t count as loss for you? Good luck.

What might of been overlooked here, is the fact that Small Claims Court is limited to £5000.

Above that is very much more complex law, and you are going to need a Solicitor in my opinion for 2 hours before Court, 2 hours admin on the case, letters to their legal department to try to resolve this before Court, and then on the day the Soliciotr even with a 10am listed time, might be with you until 4pm. Your looking at the best part of £2000 in legal costs, as well as the cost of the application, what is higher than small claims court.
