Generic Listings
So, I sell products that are NOT generic - they are branded.
The Brand doesn't create it's own listings on Amazon
Many of the products have been created with a 'generic' brand.
I therefore cannot join the listing
I cannot create a duplicate
WHAT DO I DO???
Can a mod give me an answer or a fellow seller with more knowledge than me?

If a generic listing has already been created then you can either create your own generic listing or get GTIN exemption for the brand in the category you want to list in and create you own listing with the brand.
The only issue will be if the generic listing has been created with the EAN on the product (if it has one)

If it is showing as branded as in, it has packaging and or inserts and or products that bear a trademark even if they look similar then in the eyes of the law and Amazon they are not then generic.
If your selling on behalf of a company that does not sell on Amazon then the easiest way to deal with it, would be to contact the company and ask for permission to sell and use their trademark on Amazon. You can then submit to Brand registry and go through the process, which would unlock the ability to create new listings.
Then see GS1 and get barcodes assigned to the respective company.
If you list on a listing and it does not match exactly to the letter then sadly you will find one of two things happening, one you will no doubt receive complaints of selling counterfeits or trademark violation and your account will be threatened.
If the item is showing as brand name Generic, then your free to list on it provided the product matches exactly.
For the purposes of Duplicates, if yours is branded then it would need its own listing. Amazon can of course change Generic to a brand name but that would need the documents and GS1 information to show that the EAN/Barcode has been applied to the listing incorrectly.
But its far better to get the right name, the right EAN and right listing for the brand for longevity.
As picture this, you go to the listing, you jump on as a seller and tomorrow you wake up and find out that there is a keyring on the image too, you have sold ten and customers now expect that too, when you dont send it, each negs your account. By the time you have appealled it and if you win the damage is imeasurable.
Easier to get the offiical brand authority, brand register it and then have control of the listing.
In addition, please be careful when building listings, I dont say this nastily, but many have gone on, used the images from the Generic listing and then received multiple violations for copyright infringement for using someone elses images.
So its best to use your own images or those the brand directly provide and can evidence are theirs.

You can create a stand alone your own listing, same like as Private label listing
