Customer says not received item was stolen from his door step

i sold a item to someone in ireland last november delivered via hermes they sent a picture of its location behind his step customer said its not there and been stolen so i had no choice but to refund i have just had a message of him saying the item is faulty and what warranty is available the conversion trail in the messages is still there with him saying it was stolen,so now he has admitted he has received the item surely i should get my money back.

If the item was really stolen after being delivered, it would be the buyer’s fault.

You shouldn’t have issued the refund like that, without thinking, when having the proof of delivery.

Now, your buyer already has his money back and the item as well. I am not from the UK so don’t know how the Small Claims Court works, but I would definitely consider the option of sending a Letter Before Action and demanding repayment.

Ask the customer to return item back to you (promise a refund or replacement) Then at least you will have your item back.
