Prepare for the new General Product Safety Regulation

If you sell non-food products in the EU and Northern Ireland, you’ll be required to meet General Product Safety Regulation (GPSR) requirements in 2024.

On December 13, 2024, the GPSR will introduce new requirements for most non-food consumer products.

To comply with the regulation, you’ll be required to do the following by December 13, 2024:

  1. Ensure all the products you sell in the EU and Northern Ireland meet existing labelling and traceability requirements.
  2. Have an EU Responsible Person for those products.
  3. Label the products with the contact information of the Responsible Person, the manufacturer, and, if applicable, the importer.
  4. Label products with the type, batch or serial number.
  5. Label products with safety information and warnings, where applicable, in the language of the country of sale.
  6. Display the Responsible Person information and the manufacturer’s name and contact details for each product in online listings.
  7. Display a product picture and any other information needed to identify the product in online listings.
  8. Display warning and safety information in online listings, in the language of the country of sale.

To prepare for this regulation to take effect, we recommend that you complete the first five requirements as soon as possible. In early 2024, we’ll update you with instructions on how to complete requirements 6 to 8.

I really can't see this being workable. The majority of listings on Amazon will need to be updated by sellers to show the responsible person, safety, warnings and images etc.

This is fine if you are a brand owner and manufacturer your own products but if you are not and buying direct from the manufacturer or wholesale it will not necessarily be easy to update the listing.

So I am assuming it is the manufacturer who has to appoint the Responsible Person? What happens if they don't do this in time or are just not bothered by it? How easy will it be to get this information for those sellers who buy directly from a wholesale source?

What happens to stock which is not labelled with this information? No manufacturer I know are currently labelling stock with the required information and I can't see this happening quickly.

There are so many more questions here

If the listings are not updated can they still be sold within the UK (excluding NI)?

I am hoping they either let you remove NI or block listings being sold in NI/EU if they don't meet approval.

Although looking at the help page it just suggests Amazon will remove the listings if they are not compliant as it states

We’ll remove listings if we find they aren’t compliant with the GPSR on December 13, 2024. Provide the required information to us in advance of that date to ensure it is validated in time.

There maybe nothing left by this time next year!

To top it all it will be introduced during the busiest time of the year.....you thought the EU could have waited until the 1st Jan!

'Before February 2023, product safety and compliance information could only be submitted via product manuals (limited to brand owners) and product attributes. In February 2023, we introduced the "Product safety and compliance" image variant to make it easier to upload product safety labelling, warnings, and markings to Seller Central and display them on the relevant detail pages. The information should be contained in up to six images that show all sides of the physical product or of its packaging, including labelling, warnings, and markings required for the product. The images should exactly represent the product or its packaging as it is shipped, and as it would appear in a physical store, and you must ensure the labelling, warnings, and markings are clear and legible in the images. There is an 'Image Manager' page on Amazon Seller Central, this has options to add extra images I think. I never knew this existed before now.

Uploading the images is not the problem. I only have a modest size inventory of around 1000 SKU's it will however take me a significant time to photograph each item and upload the images.

This said none of my current products have the necessary labels on as Manufacturers are not adding them at the moment.

I have read one article which suggests that items brought to market before the 13th December will not be subject to the regulation. However I can't see Amazon respecting this.

It is an extremely time consuming exercise and it is not just sellers who need to be onboard with it, it is also Manufacturers too.

I see, your problem is that the manufacturer is not labeling the products in the way which it will need to be labelled, once this kicks in.

Yes, manufacturers will need to get on board with this.

Could you reach out to the manufacturer and ask what they intend to do about this?

If it is the case that items brought to market before the 13th of December will not be subject to the regulation then manufacturers need to know that Amazon are taking a different view for the products sold on Amazon marketplaces.

I have spoken to a lawyer and she says that English Law does not require you to trade in NI if you do not wish to do so.

FBM, Ebay and many websites simply allow you to turn "off" NI.

The simplest solution here is that FBA simply introduce a button allwing every switch off FBA.

And Amazon needs to anounce the introduction of the off button for NI immediately to stop the stress being caused to thousands of sellers.

On the 13th of December Amazon will remove non compliant listings according to their help page.

What is not clear whether Amazon will allow listings to remain compliant if you remove NI from your templates and do not deliver to the UK.

It has been asked a number of times for Amazon to clarify this but it appears they don't read the replies to their own posts or if they do they just ignore the questions raised.

BREXIT - the gift that keeps on giving, on and on and on.

I've escaped the EU responsible person malarkey so far but now, we will all have to incur more costs to assign one and change all packaging to add their contact details. Incredible!

If I could switch off Northern Ireland, I would, but as far as I know, this is not possible for FBA. I would also have to switch off FBA Export and lose even more sales.

A ridiculous situation.

It would be helpful if Amazon can clarify that if we switch off FBM sales for Northern Ireland and EU that sellers will not be impacted by this. To expand on this if sellers are only selling to England, Scotland and Wales they will not be required to add responsible person information.

For FBA orders will it be possible to restrict sales to Northern Ireland going forward so that sellers are able to opt out of this regulation?

In February 2023, we introduced the "Product safety and compliance" image variant to make it easier to upload product safety labelling, warnings, and markings to Seller Central and display them on the relevant detail pages. The information should be contained in up to six images that show all sides of the physical product or of its packaging, including labelling, warnings, and markings required for the product. The images should exactly represent the product or its packaging as it is shipped, and as it would appear in a physical store, and you must ensure the labelling, warnings, and markings are clear and legible in the images. If the mandatory labelling, warnings, and markings are contained in a document accompanying the product, an image of the document showing the mandatory information should be uploaded. If necessary, provide additional close-up photos of the labelling, warnings and markings. For more information on the product safety and compliance image variant, see Image variants.

For instance, images submitted by registered brand owners will be prioritized for display on the detail page above other seller-submitted images. There is an 'Image Manager' page on Amazon Seller Central, this has options to add extra images I think. I never knew this existed before now.

Uploading the images is not the problem. I only have a modest size inventory of around 1000 SKU's it will however take me a significant time to photograph each item and upload the images.

This said none of my current products have the necessary labels on as Manufacturers are not adding them at the moment.

I have read one article which suggests that items brought to market before the 13th December will not be subject to the regulation. However I can't see Amazon respecting this.

It is an extremely time consuming exercise and it is not just sellers who need to be onboard with it, it is also Manufacturers too.

I have spoken to a lawyer and she says that English Law does not require you to trade in NI if you do not wish to do so.

FBM, Ebay and many websites simply allow you to turn "off" NI.

The simplest solution here is that FBA simply introduce a button allwing every switch off FBA.

And Amazon needs to anounce the introduction of the off button for NI immediately to stop the stress being caused to thousands of sellers.

I've escaped the EU responsible person malarkey so far but now, we will all have to incur more costs to assign one and change all packaging to add their contact details. Incredible!

If I could switch off Northern Ireland, I would, but as far as I know, this is not possible for FBA. I would also have to switch off FBA Export and lose even more sales.
